Terms of service
Effective for new purchases from 12:00 am AEST (Brisbane time), 25 September 2026. Earlier purchase promises and Australian Consumer Law rights are preserved.
About us and these terms
The seller is Sun Chaser Ebikes Pty Ltd, trading as Sun Chaser eBikes, ABN 69 671 821 819, 24 Porto Boulevard, Burleigh Waters QLD 4220, Australia. Contact sales@sunchaserebikes.com or 0401 830 966. Visits are by appointment.
These terms explain purchases from us and use of our website. Read them with the shipping policy, returns policy, warranty and privacy policy. Australian Consumer Law and any other rights that cannot lawfully be excluded take priority. Existing orders retain the terms and express promises applicable when made.
Choosing a product
Check the model, dimensions, intended use, load limits and accessory compatibility. Tell us about any particular purpose or compatibility requirement on which you need our advice. We remain responsible for our product descriptions and express promises. Images may show optional accessories; the listing identifies what is included.
Public-road eligibility depends on the exact model, configuration and applicable state or territory rules. A selectable mode or a certificate for one component is not proof of whole-bike compliance. See our safety guidance and ask for model-specific information before buying.
For sales covered by Queensland's e-mobility rules, it is illegal to sell an e-mobility device or off-road motorbike to a person under 16. Proof of age must be checked through an appropriate process. Riding exemptions do not remove the minimum purchasing age. Do not email an identity document unless we have confirmed a suitable secure verification method.
Orders, prices and payment
Use accurate order and contact details and a payment method you are authorised to use. Prices, inclusions and any applicable delivery charges are shown before purchase or expressly agreed with you. An order or payment acknowledgement is not a notice that goods have been dispatched or are ready to collect.
If there is an obvious pricing error, a stock problem, a payment issue or another genuine obstacle to fulfilment, we will contact you promptly to explain it and discuss the lawful options. We will not silently substitute a product, increase an agreed price or retain money for an order we cancel and cannot supply. Where we cancel and a refund is due, we return the applicable payment through the original payment method. This clause does not create an unrestricted right to cancel an accepted order or override your legal rights.
Delivery, preorders and cancellations
Delivery, preparation, tracking and collection arrangements are explained in our shipping policy and order-specific information. Preorder dates are estimates unless expressly guaranteed. We communicate material delays and discuss your options, including any applicable cancellation and refund rights.
Complete bikes purchased under the new returns policy have no change-of-mind return or exchange entitlement. Contact us promptly about a request to change or cancel an order; we confirm any agreement in writing. This does not limit remedies for a fault, non-supply, misdescription or another legal entitlement. Earlier purchases retain their original promises.
Warranty and support
Our additional Sun Chaser warranty and any model-specific manufacturer warranty sit alongside consumer guarantees. Normal maintenance and agreed paid services are different from a remedy we must provide without charge. Contact us about a suspected fault before arranging transport or third-party repairs where practicable; this does not remove statutory rights to recover reasonable costs.
Website use
Use the site lawfully and do not interfere with its operation, submit malicious content or misuse another person's information. We may take proportionate steps to protect the site from abuse or a security incident. This does not remove our obligations for an existing order.
We aim to keep the website available and information accurate, but maintenance and technical interruptions can occur. A website-availability statement is not a disclaimer of product quality, durability, fitness for purpose or the accuracy of a representation you reasonably relied on.
Our site content and branding remain protected by applicable intellectual-property rights. Third-party sites have their own terms; linking to them does not remove our responsibilities for goods or services we supply.
Privacy and communications
Our privacy policy explains personal-information handling and your contact options. A purchase or acceptance of these terms is not blanket consent to promotional messages. Marketing preferences and necessary order, safety or service communications are handled separately.
Complaints, liability and changes
Contact us with your order or case reference and the outcome you seek. If the issue remains unresolved, ask for review by the business owner. You can use the external consumer-law remedies available to you.
We do not exclude or limit liability that cannot lawfully be excluded or limited, including consumer guarantees and applicable rights to compensation. Nothing requires you to indemnify us for our own failure to meet those obligations.
We may update these terms for future use and future purchases. A later website update does not retrospectively alter an existing order or remove an accrued right. Australian law applies, including the mandatory consumer protections applicable to your transaction; this does not take away a court or tribunal option available under law.
